Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the eupeak.io API and developer portal, operated by Samarkand OÜ (“eupeak.io”, “we”, “us”).

By creating an account or using the API, you agree to these Terms.

1. The service

eupeak.io provides a compliance intelligence API aggregating sanctions lists, PEP databases, and adverse media sources.

The service is provided for use by businesses and developers for compliance, due diligence, and risk screening purposes.

2. Account registration

You must provide accurate and complete information at registration. You are responsible for all activity under your account and API keys. Notify us immediately at support@samarkandindustries.com of any suspected unauthorized access to your account.

3. Permitted use

You may use eupeak.io for lawful compliance and due diligence, including:

• Counterparty screening
• Supplier and third-party due diligence
• AML/KYC workflows
• ESG and Human Rights risk assessment
• Regulatory compliance reporting

4. Prohibited use

You may not use eupeak.io to:

• Facilitate illegal activities or circumvent sanctions
• Screen individuals for purposes other than compliance due diligence
• Resell or redistribute screening results as a standalone data product without a specific reseller agreement with Samarkand OÜ
• Reverse-engineer, scrape, or systematically extract underlying datasets
• Overload or abuse the API in bad faith
• Use the service in violation of applicable privacy or data protection law

5. API keys and security

API keys are confidential. You are responsible for keeping them secure. Samarkand OÜ is not liable for unauthorized use resulting from your failure to secure your credentials.

6. Usage limits and billing

Usage is billed monthly according to your selected plan. Overages are charged at €2.00 per screening above your plan limit, unless you have a separate Enterprise agreement.

Accounts with unpaid invoices may be suspended after 14 days notice.

7. Data and accuracy

eupeak.io aggregates publicly available data from third-party sources. We do not guarantee the completeness, accuracy, or currency of results.

Compliance decisions must be made by qualified personnel. eupeak.io is a data infrastructure tool, not a compliance advisor.

8. Intellectual property

“eupeak.io” is a trademark of Samarkand OÜ. All platform code, API design, documentation, and branding are the exclusive property of Samarkand OÜ.

9. Limitation of liability

To the maximum extent permitted by law, Samarkand OÜ shall not be liable for indirect, incidental, special, or consequential damages arising from use of the service.

Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.

10. Termination

Either party may terminate with 30 days written notice. Samarkand OÜ may suspend accounts immediately for material breach of these Terms.

11. Governing law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be subject to the exclusive jurisdiction of the Estonian courts.
